“FISA preempts or displaces the state secrets privilege” in this case. 564 F. Supp. 2d. at 1124. “To proceed with their FISA claim, plaintiffs must present to the court enough specifics based on non-classified evidence to establish their ‘aggrieved person’ status under FISA.” Id. at 1135.
