An onsite inspection of window replacements on the property was conducted pursuant to the Decision and Order entered on September 2, 1993. The inspection determined that the replacement windows used by the Applicant were "flatter in appearance than those of the surrounding neighborhood and ... in fact offensive especially when light is falling on the building." The Mayor's Agent concluded from additional evidence that this "flat and distorted appearance" was caused by the use of flat muntins, which could be avoided by the use of three-dimensional muntins. The Mayor's Agent also found that, while three-dimensional muntins were difficult to locate, such muntins were being manufactured.

Consistent with the Purposes of the Act:

The Mayor's Agent denied the application for replacement windows, apparently relying on the fact that a type of muntin was available, though not easy to locate, which would have preserved the depth of the original windows.


The Mayor's Agent personally telephoned the Vinyl Window and Door Institute to determine availability of three-dimensional muntins. According to that Institute, the flat muntins were "easier and more economical to manufacture and install and thus most manufacturers of vinyl windows do not manufacture the three-dimensional muntin," however, they were available. The Mayor's Agent was persuaded by arguments of the Historic Preservation Review Board staff that found that if the original windows could not be preserved, the depth of the originals should be maintained with replacement windows (which presumably would be offered by three dimensional muntins).
