The Applicant applied for a permit to construct a roof deck on his home, a contributing building in the LeDroit Park Historic District. The deck would have been visible from the public way. The Historic Preservation Review Board (“HPRB”) unanimously denied the permit as inconsistent with the character of the historic district. The Applicant could not establish at the Mayor’s Agent hearing that the HPRB had ever approved a roof deck in a house in the LeDroit Park Historic District. The Mayor’s Agent deferred to the judgment of the HPRB in matters pertaining to compatibility, and thus denied the permit.
