Applicant, American Pharmacists Association, sought to consolidate five subdivisions, including a subdivision containing Applicant's original headquarters building, an individual landmark listed on the D.C. Inventory of Historic Sites and known as the "Pope Building." The consolidation of subdivisions was sought in anticipation of the sale of four of the subdivisions to the Applicant by the federal government, and in anticipation of the Applicant's building an addition to the Pope Building on its new property. The Mayor's Agent granted the subdivision permit as "consistent with the purposes of the Act and thus necessary in the public interest."
Mayor's Agent Procedural:
The Mayor's Agent noted that the subdivision was but one minor step in a lengthy and complex review process that included (1) a federal undertaking under Section 106 of the National Historic Preservation Act; (2) a major federal action under the National Environmental Policy Act; (3) approval of the proposed new construction by the Commission of Fine Arts and the National Capital Planning Commission; (4) review of the new construction by the Historic Preservation Review Board and the Mayor's Agent; and (5) an application for relief from the D.C. Zoning Commission.
Consistent with the Purposes of the Act and Necessary in the Public Interest:
As of the hearing on the subdivision application, the Commission of Fine Arts and the National Capital Planning Commission had approved the concept for the Applicant's new construction and the Historic Preservation Review Board also had recommended approval of the proposed addition and subdivision as consistent with the purposes of the Act,
The Mayor's Agent found that the proposed subdivision would allow for development of the Applicant's properly in a manner that retains and enhances the character of the original landmark building. The new addition was sensitively designed to frame the Pope Building's design, to complement the monumental Beaux Arts style of the Pope Building, and to protect the Pope Building's freestanding qualities through adequate setbacks. The proposed new construction would allow for the continued use and viability of the landmark building as originally intended. Therefore, subdivision to allow for the new construction was consistent with the purposes of the Act and necessary in the public interest.
