Hukm al-ijha wa al-hadanah fi zill marad al-idz

Is it permissible to abort an embryo infected with AIDS? Does AIDS deprive the mother of her right to be the guardian of her child? These two questions are the main focus of this paper which was submitted to the symposium held by the Islamic Organization for Medical Sciences (IOMS) in Kuwait during the period 6-8 December 1993 on AIDS and its social problems. As for the first question, the paper is inclined to prohibit abortion even before the lapse of 120 days of pregnancy and to permit it only if it endangers the mother?s life. Concerning the second question, the author argues that the mother?s right of guardianship should not be affected by her being infected with AIDS because the disease is not transmitted by just mixing with other people.
