This paper was submitted to the symposium held by the Islamic Organization for Medical Sciences (IOMS) in Kuwait during the period 18-21 April 1987 on some medical practices from an Islamic ethical perspective. The author argues that the question of what the physician should do when positive law conflicts with Sharia in his professional practice is just a hypothetical question in the Muslim world and especially in Kuwait. He refers to different cases, including selective abortion, where no real conflict between Sharia and law can be traced. The author concludes that if such a conflict ever factually happened the physician should, in principle, abide by positive law. ..MH:
